Immigration Update

The new points based system (“PBS”) to be introduced this year will replace the current structure of immigration rules and procedures. It is intended to simplify the current system of immigration law and the new 5 tier system will apply to all non-EEA nationals migrating to the UK, except those entering through family sponsorship applications.

 

The new scheme will consists of five tiers as follows:

 

·       Tier 1: highly skilled, entrepreneurs, investors and post-study workers 

·       Tier 2: skilled workers (which will replace the work permit scheme)

·       Tier 3: low skilled

·       Tier 4: students

·       Tier 5: temporary workers and youth mobility

 

With the exception of Tier 1, all applicants must be sponsored by a licensed sponsor.

 

 

What it means for employers? 

 

The PBS will involve significant changes for employers wishing to employ foreign nationals in the UK. Employers must register as licensed sponsors and will have a duty to ensure that overseas nationals satisfy entry clearance requirements and do not breach the conditions of their immigration leave. As of the 29th February 2008 employers will face penalties and therefore it is advisable for employers to ensure that they meet the requirements and set up a system for compliance.
