Sole Representative Visa Eligibility

To gain entry to the UK under the Sole Representative of an Overseas Business Visa you must:

  • Have been hired and employed by a business that’s outside the UK.
  • Work full-time for your employer once you arrive in the UK.
  • Be a senior-level employee within an overseas-based company.
  • Have complete authority to make operational decisions on behalf of the business.

Under the conditions of a Sole Representative Visa, you are not allowed to take up any other employment and you cannot be a majority shareholder in the business by whom you are employed.

The business you represent must:

  • Be primarily based outside of the UK.
  • Have no other active branch, subsidiary or other representative of the company already based in Britain.
  • Intend to setup and run a registered branch or fully-owned subsidiary of the overseas business.
  • Intend for the branch or fully-owned subsidiary that is registered to operate in a similar capacity to its overseas operation.

Sole Representative of an Overseas Business Visa and Dependents

A Sole Representative Visa allows holders to bring dependents to Britain including a spouse and/or children under the age of 18. However, you will need to show evidence of funds to support yourselves in the UK without accessing public benefits.

Benefits of a Sole Representative Visa

A Sole Representative Visa allows you to remain in the UK for three years, initially. After three years, it’s possible to extend your stay in the UK by a further two years. Any eligible dependants will be allowed to work or study in the UK without any immigration restrictions.

After you have been in the UK for five years, you can apply to settle in Britain permanently.
