Do you represent a business based outside the European Economic Area (EEA) and interested in expanding and establishing a presence in the UK? If so, Ash Norton, can help. Our specialist business immigration lawyers have vast experience advising and assisting overseas business representatives with the UK’s complex immigration rules, and aim to make the process run as smoothly and quickly as possible.
What is the Business Representative Visa?
The representative of an overseas business visa is a special kind of visa made available to businesses based outside of the EEA that have plans to establish themselves in the UK. It is designed for individuals who have been identified within a business as being capable of being its sole representative in the UK, in order to either create a UK branch office or a subsidiary of their parent company.
Representative of Overseas Business Visa Criteria
The representative visa is, like all visas, only available where certain criteria have been satisfied. As mentioned earlier, it needs to be evidenced that a company is intending to send someone – their representative – to the UK with a view to establishing a commercial presence here.
It is important to keep in mind that before the Home Office will grant the visa, it will need to be convinced that the individual who is the subject of the visa is a suitable candidate: they will either need to have been specifically employed in order to develop their company’s presence beyond its domestic borders, or have been employed at a senior level in the company. Moreover, the individual will also need to prove that they, amongst other things:
- Are able to maintain and accommodate themselves and any dependents joining them adequately, without recourse to public funds, for the duration of the visa;
- Have sufficient command of the English language; and,
- Have the necessary authority to make decisions without reference to the parent company.
Commercially Minded Immigration Lawyers
The sole representative visa is an attractive option for businesses that have ambition to secure a place in the UK market. However, it is vital that any company that has this plan or aspiration takes the necessary steps to build a convincing application for the Home Office, evidencing the intentions of the business.
